APPLiA Europe has recently sent a complaint to the EU Ombudsman to urge action leading to aligning the implementation of the SCIP Database with its legal basis.
The SCIP Database is a “data bank” of Substances of Concern in articles, or in complex objects (Products) under the Waste Framework Directive. Companies supplying these kind of articles are required to submit information on these to ECHA, the European Chemicals Agency. The data, made available to waste operators, and consumers upon request, would promote non-toxic material cycles in the EU. The Database will apply on 5 January 2021.
However, according to APPLiA, that fully supports the objectives of the Database, the current ECHA implementation exceeds the legal basis for the Database, as laid down under Article 33 REACH, as explained the Association general director, Paolo Falcioni.
«The SCIP Database as currently implemented by the EU Institutions – he said – constitutes a misalignment with what is written in the law. That is why we sent a complaint to the EU Ombudsman to urge action leading to aligning the implementation of the Database with its legal basis. Because of the relevance of the SCIP Database legal ambition within the EU Chemicals strategy, the tool must not miss its purpose.»
